1. Acceptance of Terms
By accessing or using the employment connecting services provided by the Principled Chiropractic Association (hereinafter referred to as “PCA”), you (“User”) agree to comply with and be legally bound by these Terms of Use. If you do not agree to these Terms, you must not use our services. The PCA reserves the right to modify these Terms at any time, and continued use of the services constitutes acceptance of any changes.
2. Service Description
The PCA provides an online platform that allows chiropractors from around the world (“Candidates”) to submit their resumes and connect with chiropractic practices (“Employers”) seeking associates. While the PCA facilitates these connections, it does not act as an employer or an employment agency. The PCA is not responsible for the content of job postings, the quality or legitimacy of the job opportunities, or the outcome of any hiring decisions made by Employers.
3. User Responsibilities
- 3.1. Accurate Information: Users must provide accurate, current, and complete information when submitting their resumes or profiles. Users are solely responsible for any information they provide, and the PCA disclaims any responsibility for inaccuracies or omissions in user-submitted information.
- 3.2. Compliance with Laws: Users agree to comply with all applicable local, state, and federal laws and regulations regarding their employment and job search activities. Users shall not engage in any unlawful conduct, including but not limited to discrimination, harassment, or false representations.
4. Limitations of Liability
- 4.1. No Employment Guarantees: The PCA does not guarantee that any Candidate will find employment or that any Employer will find a suitable Candidate through the PCA’s services. The PCA is not responsible for any disputes between Candidates and Employers, nor for any claims arising from the employment relationship, including claims of wrongful termination or workplace disputes.
- 4.2. Indirect Damages: To the fullest extent permitted by law, the PCA shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the use of the employment connecting services, including but not limited to loss of profits, loss of opportunities, or emotional distress, even if the PCA has been advised of the possibility of such damages.
- 4.3. Third-Party Interactions: Users acknowledge that interactions with third parties found through PCA’s services are solely between the User and the third party. The PCA shall not be responsible for any injury, damage, or loss incurred as a result of such interactions.
5. Third-Party Websites and Services
The PCA may provide links to third-party websites or services for User convenience. The PCA does not endorse, guarantee, or assume responsibility for the content or practices of any third-party website or service. Users access these websites at their own risk, and the PCA is not liable for any damages resulting from such access.
6. Intellectual Property Rights
- 6.1. Ownership: All content, trademarks, and other intellectual property associated with the PCA and its services are owned by the PCA or its licensors. Users are granted a limited, non-exclusive, non-transferable license to access and use the services for personal, non-commercial purposes. Unauthorized use of the PCA’s intellectual property is strictly prohibited.
- 6.2. User Content: By submitting a resume or profile, Users grant the PCA a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and distribute the submitted content for the purpose of providing the services. The PCA reserves the right to remove any content that violates these Terms or that the PCA deems inappropriate.
7. Indemnification
Users agree to indemnify, defend, and hold harmless the PCA, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to:
- Any information or content submitted by the User.
- Any violation of these Terms of Use.
- Any infringement of any rights of another party, including intellectual property rights.
- Any disputes arising between Users and third parties.
8. Modification of Terms
The PCA reserves the right to modify these Terms of Use at any time and at its sole discretion. Changes will be effective immediately upon posting on the PCA website. Users are encouraged to review these Terms periodically for updates. Continued use of the services after changes constitutes acceptance of the modified Terms.
9. Governing Law
These Terms of Use shall be governed by and construed in accordance with the laws of The United States of America, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the services shall be subject to the exclusive jurisdiction of the courts located in the USA.
10. Severability
If any provision of these Terms of Use is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions shall remain in full force and effect.
11. Waiver
The failure of the PCA to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision or any other right or provision of these Terms.
12. Entire Agreement
These Terms of Use constitute the entire agreement between Users and the PCA regarding the use of the employment connecting services and supersede all prior agreements and understandings, whether written or oral, regarding the same.
